Addresses the interrelationship between s 19 of the Bill of Rights Act 1990 and the use of the comparative approach. Examines the development of discrimination jurisprudence in NZ and the NZ courts' approach to the formulation of comparator groups. Considers the judgement in 'B v Chief Executive of the Ministry of Social Development'. Proposes a change in approach to remedy the deficiencies of the comparative approach and give substance to the proper construction of s 19.
